Acceptance of terms
By using the Cocomo.dev website (the “Site”), you agree to these Terms of Use (“Terms”). If you don’t agree, please don’t use the Site. Stopping use is your remedy if you’re unhappy with the Site or anything on it.
Any posted rules for particular parts of the Site, such as the contact form, are part of these Terms. We may update the Terms at any time by posting the new version here with a new “last updated” date. Continuing to use the Site after a change means you accept the revised Terms, so please check back from time to time.
In these Terms, “we,” “us,” and “Cocomo.dev” mean Cocomo.dev, a sole proprietorship based in Portland, Oregon, and include its owner and the contractors and service providers who help run the Site.
Services and site purpose
Cocomo.dev provides digital development and related consulting services. The Site describes those services, shows a portfolio of past work, and lets clients and prospects contact us or submit business information, such as a service inquiry.
You’re responsible for the equipment and internet access you need to use the Site. We may change, suspend, or discontinue any part of the Site at any time, with or without notice, and we aren’t liable for doing so. Information on the Site describes our services in general; it isn’t an offer or a quote.
Privacy and information you send us
If you submit information through the Site’s forms or by email, we use it for communication, project scoping, and contractual purposes, and we store it securely. Our Privacy Policy explains what we collect and your choices, and it is part of these Terms.
Please don’t send passwords, payment details, or other confidential or sensitive information through the contact form or by email unless we’ve agreed in writing how it will be handled. Confidentiality for project work is covered by the Service Agreement described below.
Acceptable use
Please use the Site lawfully and respectfully. You agree not to:
- break the law or violate anyone’s rights through your use of the Site;
- upload or send viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to the Site, its hosting, or anyone’s data;
- try to get around the Site’s security, scan it for weaknesses without our written permission, or overload it;
- use the contact form for spam, advertising, or other unsolicited solicitations, or submit false or fraudulent information;
- impersonate any person or organization; or
- copy, scrape, or resell the Site or its content for commercial use.
We may block access to the Site and report suspected unlawful activity to the appropriate authorities.
Intellectual property
All original content on this Site, including text, code, designs, and other creative materials, is the property of Cocomo.dev or its licensors and is protected under applicable copyright and intellectual property laws. You may view and print pages for your own personal, non-commercial use. Otherwise, you may not copy, modify, distribute, or create derivative works from any part of this Site without prior written permission.
Client work in our portfolio
Certain images, graphics, logos, or screenshots of past client work displayed on this Site are the intellectual property of those respective clients. Such materials are shown with the client’s express verbal or written permission for the limited purpose of showcasing Cocomo.dev’s portfolio and professional capabilities. Cocomo.dev makes no ownership claim to any client trademarks, copyrighted works, or proprietary designs featured for demonstration or marketing purposes.
Unless otherwise agreed in writing, non-confidential aspects of completed work, such as publicly launched websites, design elements, client names, or logos, may be displayed in our portfolio, on this Site, or in other promotional materials. Cocomo.dev will not disclose or display any confidential or proprietary information without the client’s explicit written consent.
Trademarks
The Cocomo.dev name and logo are trademarks of Cocomo.dev. All other trademarks and logos appearing on this Site remain the property of their respective owners. Nothing in these Terms grants you any right or license to use any trademark, logo, or proprietary material displayed on the Site without the owner’s prior authorization.
Copyright concerns
We respect the intellectual property of others. If you believe material on this Site infringes your copyright or other rights, email [email protected] with a description of your work, where the material appears on the Site, how to reach you, and a statement that you believe in good faith that the use isn’t authorized. We’ll review the request and remove material when appropriate.
Third-party links and tools
The Site may link to third-party websites or tools, or mention information, software, or services from other parties. We don’t control them and aren’t responsible for their content, accuracy, security, or practices, and some may contain material that people find inappropriate or offensive. A link or reference is provided as a convenience and doesn’t mean we endorse the site or party. Anything you agree to with a third party is solely between you and them.
Service agreements (contracts control)
Project work is governed by a separate written Service Agreement (a statement of work, master services agreement, or similar). If these Terms conflict with a Service Agreement, the Service Agreement controls for the contracted services.
- No guarantees of outcome: We don’t guarantee specific business results, such as revenue, rankings, or conversions.
- Estimates and timelines: Any timelines, projections, or estimates are non-binding and may change because of scope, dependencies, or third-party factors.
- Client responsibilities: You are responsible for timely feedback, approvals, and providing required assets and access. Delays may affect schedules and deliverables.
- Third-party licenses and accounts: You are responsible for fees and compliance for third-party services, platforms, or licenses used in your project, unless the Service Agreement says otherwise.
Disclaimer of warranties
The Site and its materials are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will meet your requirements or be uninterrupted, timely, secure, or error-free, that the information on it is current, accurate, or complete, or that it is free of viruses or other harmful components.
The Site may contain technical mistakes, inaccuracies, or typographical errors, and we may change it at any time without notice. Temporary interruptions are normal, and we have no control over the third-party networks you use to reach the Site. Anything you download or obtain through the Site is at your own discretion and risk.
Some states or jurisdictions don’t allow the exclusion of certain warranties, so some of these limits may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Cocomo.dev and its owner will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, data, or use, arising from or related to your use of the Site or any website linked from it. Your sole remedy for dissatisfaction with the Site is to stop using it.
This section covers use of the Site. Liability for project work is governed by the Service Agreement. Some jurisdictions don’t allow the limitation of certain damages, so some of these limits may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Cocomo.dev and its owner from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use or misuse of the Site or your violation of these Terms. We may, at our own expense, take over the defense and control of any matter you would otherwise have to cover, and you agree to cooperate with us in doing so.
Suspension and termination
We may suspend or end your access to all or part of the Site at any time, with or without notice and for any reason, including a breach of these Terms. Suspected fraudulent, abusive, or illegal activity may be reported to law enforcement. Parts of these Terms that by their nature should continue after your access ends, such as those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.
International use
The Site is operated from the United States. Although it can be reached from other countries, we make no promise that its content is appropriate or available outside the United States. If you access the Site from elsewhere, you do so on your own initiative and are responsible for following your local laws.
Governing law and venue
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Exclusive venue lies in the state or federal courts located in Oregon, USA.
General terms
These Terms, together with the Privacy Policy and any Service Agreement, are the entire agreement between you and us about the Site. If any part of these Terms is found invalid or unenforceable, it will be applied as closely as possible to its original intent and the rest will stay in effect. If we don’t enforce a provision, that isn’t a waiver of it. You may not assign your rights or obligations under these Terms; we may assign ours. We aren’t responsible for failures or delays caused by events beyond our reasonable control.
Notices
Send notices to us by email to [email protected]. We may send notices to you at the email address you gave us, or post them on the Site, and a notice posted on the Site takes effect when it’s posted.
